1. Provider and acceptance
Rosie’s Diary is provided by TRANSMUTE STUDIO LIMITED, New Zealand. If you do not agree to these terms, do not use the app or website.
Your licence to use the iOS app is also subject to Apple’s Standard EULA; these Terms govern your use of Rosie’s Diary and its services.
2. Eligibility
You must be at least 13 and legally able to agree to these terms. If local law requires a higher age for independent consent, a parent or guardian must authorize your use.
3. What Rosie provides
Rosie is a personal diary for recording skin check-ins, food context and patterns you notice. Features may include reminders, timelines, illustrative associations and exports. We may improve, change, suspend or discontinue features where reasonably necessary.
4. Not medical advice
Rosie is a self-reporting and personal health diary designed to help you record your skin, meals, symptoms and observations over time, explore possible patterns in your own records, and organise information you may choose to discuss with a healthcare professional.
Rosie is not intended to diagnose, treat, cure or prevent any disease or health condition, and it is not a healthcare provider or a substitute for professional medical advice. Its ratings, summaries and possible patterns are based on information you enter. Any association Rosie displays may help you reflect on your records, but does not prove causation and may not be clinically meaningful.
Do not start, stop or change any medication, treatment or care plan based solely on Rosie or its outputs. Speak with a qualified health professional before making medical decisions. If you have severe, rapidly worsening or otherwise urgent symptoms, seek appropriate medical care or contact local emergency services.
5. Your content and responsibility
You retain ownership of the entries and images you create. You grant Rosie only the permissions technically necessary to process that content on your device and perform actions you request. You are responsible for the accuracy of your entries, protecting access to your device, keeping any exports secure and having permission to include information about another person.
6. Acceptable use
You must not misuse Rosie, interfere with its operation, attempt unauthorized access, reverse engineer it except where law permits, introduce malicious code, infringe others’ rights, use it for unlawful purposes, or represent its output as a professional diagnosis.
7. Subscriptions and App Store billing
Paid access is purchased through Apple’s App Store. Prices, trial availability and billing periods are shown before purchase. Subscriptions renew automatically unless cancelled through your Apple Account at least as required by Apple. Deleting Rosie does not cancel a subscription. Billing, cancellation, restoration and refunds are also subject to Apple’s terms and policies.
8. Privacy and advertising measurement
Our Privacy Policy explains how information is handled. We may use lawful analytics and third-party advertising measurement services to attribute installs or subscriptions and improve campaigns. We do not send diary entries, photos, health observations, profile names or clinician exports to advertising measurement providers. Where required, tracking is subject to Apple’s permission controls.
9. Exports and third-party services
You control where exported files are sent. Once shared with another person, application or storage provider, their security and terms apply. Rosie also relies on Apple and other third-party service providers; their availability and policies may affect related features.
10. Intellectual property
Rosie’s software, character artwork, branding, interface, text and other materials—excluding your content—belong to TRANSMUTE STUDIO LIMITED or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use Rosie in accordance with these terms.
11. Availability and changes
We aim to provide a reliable experience but do not promise uninterrupted, error-free or permanently available service. Rosie is local-first and is not a backup service. Deleting the app, deleting or replacing your device, or losing access to your device may permanently delete your diary data unless you have exported and securely retained a copy. Technical faults or changes to third-party platforms may also result in unavailable features or lost local data. Export anything you need to retain.
12. Suspension and termination
You may stop using Rosie at any time. We may restrict access where reasonably necessary to protect users, comply with law, respond to misuse or discontinue the service. Provisions intended to survive termination continue to apply.
13. Disclaimers and liability
To the maximum extent permitted by law, Rosie is provided “as is” and “as available”. We do not guarantee that observed associations are accurate, complete or clinically meaningful. We are not liable for indirect, consequential or special loss, loss of data, or medical or other decisions made solely in reliance on Rosie’s outputs, except where liability cannot lawfully be excluded. Nothing in these terms limits rights you have under applicable consumer law.
14. Governing law
These terms are governed by the laws of New Zealand. New Zealand courts have non-exclusive jurisdiction, subject to any mandatory rights or forum available under the law where you live.
15. Changes to these terms
We may update these terms to reflect service, legal or operational changes. We will update the date above and provide appropriate notice of material changes. Continued use after updated terms take effect constitutes acceptance where permitted by law.
